The fine print, in normal size print. By using this website you agree to these terms. If you do not agree, please do not use the site.
The short version
- Nothing on our site is insurance, legal or tax advice.
- LuxKeep is a licensed insurance agency in the State of Florida. We do not sell policies ourselves; we connect you with the licensed insurance agents on our Agent List, who work with LuxKeep, not for LuxKeep.
- Asking for contact is optional and never required to buy anything. The agents named on our Agent List may reach out. Reply STOP to end texts.
- Give us true information and use only your own phone number.
- Disputes go to individual arbitration, not court or class actions, unless you opt out within 30 days. See section 13.
1. Who we are
This website is operated by LuxKeep Insurance Agency LLC, a Florida limited liability company ("LuxKeep," "we," "us"). LuxKeep is a licensed insurance agency in the State of Florida. We do not sell policies ourselves; we connect people with the licensed insurance agents on our Agent List. We are not an insurance company, not a government agency, and not affiliated with any mortgage lender, bank or servicer. The agents on our list work with LuxKeep, not for LuxKeep. None of them is our employee.
2. Information, not advice
Our website defines a few insurance terms in general language. They are not insurance, legal, tax or financial advice, and they are not a quote, an offer of coverage, or a promise that you will qualify. Coverage, cost and eligibility vary by insurance company, state, age and health, and every policy has its own exclusions, limitations and terms. Read any policy before you buy it, and talk to a licensed professional about your situation.
We work to keep our content accurate, but insurance rules change. We do not promise the content is complete or current.
3. Licensed agents
If you ask to be contacted, we share your request with the licensed insurance agents named on our Agent List. Each is an independent agent who works with LuxKeep, not for LuxKeep, and any of them may contact you. Any advice, recommendation, application or policy is between you, that agent and the insurance company. We are not responsible for what an agent says or does, but if an agent treats you badly, tell us; we want to know, and we stop working with agents who mistreat people.
4. Consent to be contacted
Agreeing to be contacted is optional and is never a condition of buying anything. If you agree, you give the permission described in the consent box on the form at the time you submit it. You can take it back any time: reply STOP to any text, tell any agent who calls to put you on their do not call list, or email info@luxkeep.org.
5. Electronic communications and signatures
When you tick a box or click a button on this site, that counts as your electronic signature, and it has the same effect as signing on paper. You agree that we can give you notices, disclosures and records electronically, by email or by posting them on this site, and that these meet any requirement that they be in writing. You can ask for a paper copy of any agreement or consent record by emailing info@luxkeep.org, at no cost. You can withdraw your consent to electronic communications the same way; doing so does not undo anything you agreed to before.
6. Text message terms
- What you get: a single verification code each time you confirm your number on our site. If you also ask for contact, the agent you are connected with may text you about your request.
- How often: message frequency varies. Verification codes are sent only when you request one.
- Cost: message and data rates may apply.
- Stop: reply STOP to cancel. Reply HELP for help, or email info@luxkeep.org.
- Carriers: wireless carriers are not liable for delayed or undelivered messages.
Your phone number and texts are handled as described in our Privacy Policy.
7. Your part of the deal
When you use this site, you agree to:
- Be at least 18 and a resident of the United States.
- Give true, current information, and submit only your own name, email and phone number.
- Not submit someone else's information, or use the site to harass anyone.
- Not use bots, scrapers or automated tools to submit forms or copy the site.
- Not try to get around our phone verification, break our security, or interfere with the site.
8. Our content
The site, text, design and illustrations belong to LuxKeep and are protected by copyright and trademark law. You may read and print pages for your own personal, noncommercial use. You may not sell, rebrand or republish them without our written permission. "LuxKeep" and the lighthouse logo are our trademarks.
9. Links to other sites
We may link to government sites, insurance regulators or other resources. We do not control them and are not responsible for their content or privacy practices.
10. Disclaimer
The site is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and noninfringement. We do not promise that the site will always be available or free of errors.
11. Limit of our liability
To the fullest extent the law allows, LuxKeep will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the site, or any agent or insurance company you are connected with. Our total liability for any claim relating to the site is limited to $100. Some states do not allow these limits, so they may not apply to you. Nothing here limits liability that cannot be limited by law.
12. If you misuse the site
If you break these terms, for example by submitting someone else's phone number, you agree to cover the reasonable costs and claims that result for LuxKeep.
13. Governing law and disputes
Please read this section carefully. It requires you and LuxKeep to settle most disputes by individual arbitration, not in court, and it waives jury trials and class actions. You can opt out within 30 days, as explained below.
Governing law. These terms are governed by the Federal Arbitration Act and federal law, and otherwise by the laws of the State of Florida, without regard to its conflict of law rules.
Talk to us first. Before starting an arbitration or a small claims case, send a written notice to info@luxkeep.org or to our mailing address in section 16 with your name, phone number, a description of the dispute and what you want. We will try to resolve it with you. Either side may start arbitration if it is not resolved within 30 days after the notice is received.
What arbitration covers. Any dispute between you and LuxKeep that relates to this site, our guides or emails, or any call or text you receive because of a request made on this site, including claims under the Telephone Consumer Protection Act and similar state laws. The licensed agents on our Agent List may enforce this section for disputes about their contact with you that arise from a request made on this site. Questions about whether a dispute must be arbitrated are for the arbitrator to decide, except that a court decides questions about the class action waiver.
Small claims. Either side may instead bring an individual claim in small claims court, if it qualifies and stays there on an individual basis.
How it works. The American Arbitration Association (AAA) runs the arbitration under its Consumer Arbitration Rules, available at adr.org, before a single arbitrator. The hearing will take place in the county where you live or by phone or video, and if your claim is $10,000 or less you may choose to have it decided on written submissions alone. The arbitrator can award the same individual relief a court could, including statutory damages, but only to you and only for your individual claim.
Fees. If your claim is $10,000 or less, LuxKeep will pay all AAA filing, administration and arbitrator fees, unless the arbitrator finds your claim frivolous. For larger claims, fees are split as the AAA Consumer Rules provide, and we will pay any amount the arbitrator decides is needed to keep arbitration from being too costly for you.
No class actions and no jury. You and LuxKeep each agree to bring claims only individually, not as a plaintiff or class member in any class, collective or representative action, and each waives the right to a jury trial. The arbitrator may not combine the claims of more than one person. If this class action waiver is found unenforceable for a claim, that claim will be decided in court and not in arbitration.
Many similar claims. If 25 or more similar arbitration demands are filed against LuxKeep by or with the help of the same law firm or coordinated group, the AAA will handle them in batches of up to 50, with one arbitrator per batch. Deadlines are paused for demands waiting in a batch.
Time limit. To the extent the law allows, a claim must be brought within one year after it arises, or it is permanently barred. This does not shorten any time limit that the law says cannot be shortened, including for claims under the Telephone Consumer Protection Act.
Your right to opt out. You can reject this arbitration agreement by emailing info@luxkeep.org within 30 days after you first use the site or submit a form, with your name, phone number and a clear statement that you do not want to arbitrate. Opting out does not affect anything else in these terms.
Courts. Any dispute that is not arbitrated, including if you opt out, will be handled in the state or federal courts in Miami Dade County, Florida, unless the law of your state gives you the right to bring it where you live.
14. Changes
We may update these terms. The date at the top tells you when they last changed. Changes apply from that date forward and do not change any consent you already gave.
15. The rest
If any part of these terms is found unenforceable, the rest still applies. If we do not enforce a term right away, we have not given up the right to enforce it later. These terms, together with our Privacy Policy, are the whole agreement between you and us about the site.
California users. If a complaint is not resolved to your satisfaction, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by phone at (800) 952-5210 or (916) 445-1254.
